Sherri Shepherd received an unwelcome birthday gift one day before her 48th birthday.
A Pennsylvania judge ruled Tuesday that the former "View" host is legally the mother of an 8-month-old child born via surrogacy. The surrogate was already pregnant when she and Lamar Sally decided to end their marriage last year.
Shepherd did not want custody or to be named as a parent of the child, Lamar Sally Jr., reportedly because she believed her ex wanted to have the baby in order to defraud her to get child support.
In an interview with People outside the courtroom, Sally called the ruling “bittersweet.”
“I’m glad it’s over, but I feel sad what it had come to. Now I can go back to L.A. and tend to my son.”
The baby was conceived with Sally's sperm and surrogate’s Jessica Bartholomew’s egg. Bartholomew was listed on the birth certificate as the child's mother when she gave birth last summer.
Yet despite not having a biological connection to the child, it seems that Shepherd’s excitement about his impending arrival is what helped convince the judge to name her as co-parent.
“There was some additional evidence put on the record involving some video clips involving Ms. Shepherd,” Craig Bluestein, the child’s legal representative, told People.
He cited a clip of the celeb “expressing excitement over her and Lamar going to have a baby through the help of a surrogate carrier with no genetic connection."
The actress did not appear in court for the ruling, but according to TMZ, she and her ex might have to face each other in court when figuring out details regarding child support.
Shepherd has a 10-year-old son named Jeffery from her first marriage. The two share the same birthday, which they celebrated on Wednesday.
